  1. Condition, safety and allocation of equipment

PIC NEGRE will supply equipment that has been inspected, is in proper working order and is suitable for the user's characteristics. Before handover, the necessary checks and adjustments will be carried out, including, where applicable, binding adjustment in accordance with applicable technical criteria.

The CUSTOMER must correctly provide the information needed to prepare the equipment, including the minor's age, height, weight, shoe size and skill level, where required.

The specific allocation of the equipment will be subject to existing availability. Contracting a specific range does not imply the reservation or guarantee of a brand, model, design, colour, manufacturing year or condition of new equipment. The company guarantees, in all cases, that the equipment provided has been inspected and is in suitable conditions for use and safety.

  1. Collection of equipment

The collection of the equipment will be available at the designated establishment, according to the current store opening hours:

Pic Negre La Molina - Pista Llarga, s/n, 17537 La Molina, Girona.

Store opening hours: until the opening of the ski resort, the store will remain closed on Sunday afternoons and Mondays. From November onwards: from 8:30 am to 2:00 pm and from 4:00 pm to 6:00 pm (Tuesday to Friday); Saturdays from 8:30 am to 2:00 pm and from 4:00 pm to 7:00 pm; Sundays from 8:30 am to 2:00 pm.

Handover is subject to correct completion of the contract, payment, and availability of the corresponding size and range.

  1. Term and ownership of the equipment

The rental applies exclusively to the 2026-2027 season. The CUSTOMER may use the equipment from the time of handover until the maximum return date set out in these terms.

The rental agreement does not involve the purchase of the equipment. All equipment and accessories provided will remain the property of the company during and after the rental period.

  1. Discounts and promotions

This product does not allow discounts or promotions of any kind. The price of the rates indicated in these conditions is a fixed price.

  1. Contract formalization, payment and acceptance

The company may accept different payment methods, including bank card payment via POS terminal, cash, or other means expressly accepted by the establishment.

The rental agreement will be formalised once payment has been made and the corresponding rental contract has been signed. By signing, the CLIENT declares that they have received sufficient information, have been able to consult these conditions, understand their content and fully accept them.

These conditions will be available for consultation both at the designated establishments and on the company's website.

  1. Use, custody and care

The equipment must be used exclusively by the minor for whom it was contracted and fitted. It may not be transferred, lent, or habitually used by third parties.

The CUSTOMER agrees to ensure the equipment's proper use, care and custody throughout the rental period and to take reasonable precautions to prevent its loss, theft, damage or destruction.

Improper handling of the equipment, modification of safety elements, unauthorized alteration of the bindings, or any manifestly inappropriate use or use other than that for which the equipment was designed, is prohibited.

  1. Size changes and adjustments

We know that children grow quickly. Therefore, if during the season the minor needs a size change to continue enjoying the equipment safely and comfortably, the CLIENT may visit Pic Negre La Molina so that our team can review and adjust the equipment.

As this is CLUB equipment, acquired in limited quantities per category, we cannot always guarantee a change for the same product. Subject to availability, in these cases we will provide equipment from our standard rental range (outside the CLUB range) so that the minor can continue skiing without interruptions; this change does not involve any compensation or additional charge. All changes and adjustments must be carried out or authorised by the company’s staff.

  1. Maintenance Included

The rental includes one free maintenance service during the season, as well as free advice from technical staff at any time during the rental period, at no additional cost.

The free maintenance service consists exclusively of waxing and edge sharpening of the ski.

Sole repair, adjustments, repairs arising from misuse, breakages, major damage, and any intervention other than waxing and edge sharpening are expressly excluded from this free service. Such repairs, where necessary, may be charged in accordance with current workshop rates. The assessment of the type of intervention required will be made by PIC NEGRE technical staff.

  1. Children's Ski Guarantee

The CUSTOMER may additionally contract the Children's Ski Guarantee for €10 per set of equipment, per season. The guarantee must be recorded in the contract.

Coverage for accidental breakage: 100% Where a covered accidental breakage occurs, the CUSTOMER will not have to bear the cost of repair or replacement corresponding to the covered damage.

Coverage for theft or loss: 50% El CLIENTE será responsable del 50 % del valor correspondiente al material afectado y la empresa asumirá el 50 % restante.

PIC NEGRE may request supporting documentation regarding the circumstances of the incident and, particularly in the case of theft, the corresponding report filed with the competent authorities.

In this way, the CUSTOMER who contracts the Children's Ski Guarantee benefits from these reduced costs compared with the cost that would be borne without it, in which case the provisions of section 13 will apply.

  1. Guarantee exclusions

The guarantee is intended to cover accidental events and does not cover negligent, fraudulent or intentional conduct.

  • Manifestly negligent use, or use contrary to the instructions for use.
  • Use of the equipment for purposes other than those intended.
  • Damage caused intentionally or through improper handling.
  • Unauthorized modifications or interventions on the equipment.
  • Any fraudulent act or act deliberately intended to damage the equipment.

The technical assessment of the damage and its cause shall be the responsibility of the company, without prejudice to the rights legally granted to the CLIENT.

  1. Damage, loss or theft without the guarantee

Where the CUSTOMER has not contracted the optional guarantee, they will be liable for damage, breakage, loss or theft occurring during the period in which the equipment is under their responsibility, on the terms set out in the contract and under applicable law.

The corresponding cost will be determined based on the damage caused, the repair required, or the value of the equipment that must be replaced.

  1. Return of equipment in-store

The equipment may only be returned at Pic Negre La Molina (Pista Llarga, s/n, 17537 La Molina, Girona) until 30 April 2027, inclusive, which is the standard deadline for returning the equipment.

  1. Late returns

Returns made after 23 April 2027 will be subject to a penalty of €30.

This penalty is independent of, where applicable, any amounts arising from loss, damage, theft or failure to return the equipment.

  1. Failure to return the equipment

When the CLIENT fails to return the equipment, the company may claim the full value of the unreturned equipment, including, where applicable, by making the corresponding charge to the bank token associated with the contract in accordance with the provisions set out in these conditions.

This obligation may apply both to the complete set of equipment and to any of its components individually, including skis, boots, poles, helmet, back protector, and any other item supplied.

When the CLIENT returns the equipment in conditions that prevent its reuse, the same criteria as in the case of non-return will apply, charging the full value of the affected equipment. When the equipment, despite the damage, can continue to be used by the company, the applicable repair fee will be charged according to the current workshop rates.

Payment of the corresponding amounts does not eliminate any other liabilities that may be legally enforceable.

  1. Delivery and inspection of equipment

At the time of handover, the CUSTOMER acknowledges receiving the equipment covered by the contract in proper condition for use, unless any anomaly is expressly noted at that time.

The CLIENT agrees to notify the company of any relevant anomaly detected subsequently and to stop using the equipment whenever there may be a problem that compromises its safety. The company may replace, inspect or repair the equipment whenever technically necessary.

  1. Early return of equipment

In the event of voluntary early return of the equipment before the return deadline, the following criteria shall apply:

  • Return before the opening of the ski slopes at La Molina ski resort: 100% refund of the amount paid.
  • Return before 15 December: 50% refund of the amount paid.
  • Return from 15 December onwards: it will not entitle the CLIENT to any refund.

The refund, when applicable, will preferably be made through a voucher or purchase credit redeemable at the establishment; only when this is not possible will it be made through a refund of the amount paid.

In cases of early return due to injury or another duly justified medical circumstance affecting the minor, the company may assess the return of the equipment and the corresponding refund in accordance with the previous criteria, subject to the prior submission of the relevant medical justification.

  1. Responsibility of the contracting adult

Although the equipment is used by a minor, the adult who enters into the contract will be responsible to PIC NEGRE for compliance with the contractual obligations, including in particular the proper use of the equipment, its care, custody, timely return, and payment of any amounts owed for damage, loss, theft, delay, or failure to return the equipment.

  1. Skiing activity and liability

The CUSTOMER acknowledges that skiing is a sporting activity that carries inherent risks. PIC NEGRE will be responsible for the proper condition and preparation of the equipment to the extent legally required, but will not be liable for accidents arising from the sporting activity itself, the user's conduct, incorrect use of the equipment, or circumstances unrelated to the rented equipment, without prejudice to any liability legally attributable to PIC NEGRE.

The responsible adult must ensure that the minor uses the equipment in a manner appropriate to their age, physical condition, level and abilities.

  1. Subsequent charges and card tokenization

* PENDING INTERNAL CONFIRMATION

If a card tokenization system is used, the corresponding express authorization must be obtained to securely store a bank token and make subsequent charges relating exclusively to obligations arising from the contract, such as damage, loss, theft, equipment not returned, or penalties. The system applicable to this product must be validated, in particular the token's period of validity for a seasonal rental.

  1. Data protection

The data controller for personal data is PIC NEGRE, SA. The data provided during contracting will be processed to manage the rental contract, identify the CUSTOMER and the user of the equipment, manage payments, deliveries, returns, incidents, maintenance, coverage, and other actions necessary for the proper provision of the service.

Processing will be carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD), its implementing regulations and the company's current privacy policy.

Where the contract arises from a promotion or QR code involving prior collection of personal data, such processing will also be subject to the information and privacy conditions provided in the corresponding form.

The CUSTOMER may exercise their data protection rights through the channels made available by PIC NEGRE and may consult further information at www.picnegre.com.

  1. Acceptance of these terms

Signing the contract and paying for the rental confirm that the CUSTOMER:

  • Has been able to review these terms before contracting.

  • Is aware of the guarantee's coverage and exclusions where it has been contracted.
  • Accepts the obligations to care for and safeguard the equipment.
  • Accepts these terms in full.

The conditions will be available for consultation in the store and on the company’s website.
