These terms govern the contracting, use, maintenance, custody and return of the Seasonal Children's Ski Rental Service 2026-2027 provided by PIC NEGRE, SA, hereinafter, “PIC NEGRE”.
Signing the contract and paying for the rental constitute full acceptance of these terms by the responsible adult who enters into the contract.

The service allows use of the contracted ski equipment during the 2026-2027 season, within the period and conditions set out in this document.
The product is intended exclusively for minors up to 13 years old inclusive. It may not be contracted for users aged 14 or older.
The contract must be entered into by an adult accompanying the minor who acts as parent, legal guardian, or authorized responsible person. This person shall be considered the CUSTOMER and shall assume, vis-à-vis PIC NEGRE, the obligations arising from the contracting, custody, use and return of the equipment handed over to the minor.
The final rates for the service for the 2026-2027 season are as follows:

PIC NEGRE will supply equipment that has been inspected, is in proper working order and is suitable for the user's characteristics. Before handover, the necessary checks and adjustments will be carried out, including, where applicable, binding adjustment in accordance with applicable technical criteria.
The CUSTOMER must correctly provide the information needed to prepare the equipment, including the minor's age, height, weight, shoe size and skill level, where required.
The specific equipment assigned is subject to availability. Contracting a given range does not imply a reservation or guarantee of a particular brand, model, design, colour, year of manufacture, or new condition. PIC NEGRE guarantees, in all cases, that the equipment supplied has been inspected and is in proper condition for safe use.
Equipment collection will be available from 3 November 2026 at the following authorized outlets:
Expected collection hours: 09:00 to 13:00 and 16:00 to 20:00, in accordance with each outlet's current opening days and hours.
Handover is subject to correct completion of the contract, payment, and availability of the corresponding size and range.
The rental applies exclusively to the 2026-2027 season. The CUSTOMER may use the equipment from the time of handover until the maximum return date set out in these terms.
Contracting the rental does not constitute a purchase of the equipment. All equipment and accessories supplied remain the property of PIC NEGRE during and after the rental period.
PIC NEGRE may establish promotional agreements with certain groups, entities, associations, companies, events or other partners. The list of current entities or promotions will be communicated through the relevant commercial channels and may vary during the season.
To benefit from a discount, the CUSTOMER must prove entitlement in-store by means of a membership card, ID, QR code, voucher or other valid accreditation for the relevant promotion. The discount will apply only if the accreditation is presented and validated at the time the rental is entered into.
For promotions available during the 2026-2027 season, the 10 % discount will apply exclusively to complete packs:
The discount will not apply to partial rentals, helmets, back protectors, the guarantee, repairs, or other additional products or services. Discounts and promotions may not be combined with each other or with other offers or special conditions, unless expressly stated otherwise by PIC NEGRE.
The rental will be entered into in person at one of the authorized outlets. The CUSTOMER must provide the required information, review these terms, and make the corresponding payment.
PIC NEGRE may accept different means of payment, including bank card via POS terminal, cash, or other means expressly accepted by the outlet.
The rental agreement will be formalised once payment has been made and the corresponding rental contract has been signed. By signing, the CLIENT declares that they have received sufficient information, have been able to consult these conditions, understand their content and fully accept them.
These terms are available for review both at the authorized outlets and on the PIC NEGRE website.
The equipment must be used exclusively by the minor for whom it was contracted and fitted. It may not be transferred, lent, or habitually used by third parties.
The CUSTOMER agrees to ensure the equipment's proper use, care and custody throughout the rental period and to take reasonable precautions to prevent its loss, theft, damage or destruction.
Improper handling of the equipment, modification of safety elements, unauthorized alteration of the bindings, or any manifestly inappropriate use or use other than that for which the equipment was designed, is prohibited.
Physical changes in the minor may occur during the season. Where it becomes necessary to adapt the equipment to ensure its proper use, the CUSTOMER must visit an authorized outlet so that PIC NEGRE staff can review the equipment.
Changes and adjustments are subject to equipment availability and must be carried out or authorized by PIC NEGRE.
The rental includes one free maintenance service during the season, as well as free advice from technical staff at any time during the rental period, at no additional cost.
The free maintenance service consists exclusively of waxing and edge sharpening of the ski.
Sole repair, adjustments, repairs arising from misuse, breakages, major damage, and any intervention other than waxing and edge sharpening are expressly excluded from this free service. Such repairs, where necessary, may be charged in accordance with current workshop rates. The assessment of the type of intervention required will be made by PIC NEGRE technical staff.
The CUSTOMER may additionally contract the Children's Ski Guarantee for €10 per set of equipment, per season. The guarantee must be recorded in the contract.
Coverage for accidental breakage: 100% Where a covered accidental breakage occurs, the CUSTOMER will not have to bear the cost of repair or replacement corresponding to the covered damage.
Coverage for theft or loss: 50% The CUSTOMER will be responsible for 50% of the value of the affected equipment, and PIC NEGRE will assume the remaining 50%.
PIC NEGRE may request supporting documentation regarding the circumstances of the incident and, particularly in the case of theft, the corresponding report filed with the competent authorities.
In this way, the CUSTOMER who contracts the Children's Ski Guarantee benefits from these reduced costs compared with the cost that would be borne without it, in which case the provisions of section 13 will apply.
The guarantee is intended to cover accidental events and does not cover negligent, fraudulent or intentional conduct.
The technical assessment of the damage and its cause will be made by PIC NEGRE, without prejudice to the CUSTOMER's legal rights.
Where the CUSTOMER has not contracted the optional guarantee, they will be liable for damage, breakage, loss or theft occurring during the period in which the equipment is under their responsibility, on the terms set out in the contract and under applicable law.
The CUSTOMER will bear 100% of the established value (retail price) of the damaged, lost or stolen equipment, in accordance with the rates in force for the 2026-2027 season set out in section 2.
The equipment may be returned to Pic Negre 11 - La Massana and Shusski 56 - Encamp up to and including Monday, 5 April 2027.
After that date, the equipment must be returned at the Grup Pic Negre offices in Vila - Encamp.
From Tuesday, 6 April 2027 to Friday, 23 April 2027, the equipment must be returned to:

23 April 2027 is the ordinary deadline for the return of the equipment.
Returns made after 23 April 2027 will be subject to a penalty of €30.
This penalty is independent of, where applicable, any amounts arising from loss, damage, theft or failure to return the equipment.
Where the CUSTOMER does not return the equipment, PIC NEGRE may claim the full value of the equipment not returned.
This obligation may apply both to the complete set of equipment and to any of its components individually, including skis, boots, poles, helmet, back protector, and any other item supplied.
Payment of the corresponding amounts does not eliminate any other liabilities that may be legally enforceable.
The amount to be claimed for equipment not returned will correspond to the full value (retail price) of the equipment or component affected, in accordance with the rates in force for the 2026-2027 season set out in section 2:
Where the component not returned is the poles, since these are included in the price of the pack or the skis, their value will be calculated proportionally to the price of the corresponding item, at PIC NEGRE's discretion in-store.
At the time of handover, the CUSTOMER acknowledges receiving the equipment covered by the contract in proper condition for use, unless any anomaly is expressly noted at that time.
The CUSTOMER agrees to notify PIC NEGRE of any relevant anomaly detected afterwards and to stop using the equipment where there may be a problem affecting its safety. PIC NEGRE may replace, inspect or repair the equipment where technically necessary.
Where the CUSTOMER chooses to return the equipment before the end of the season, the following criteria will apply:
Wherever possible, the refund will be made by way of a purchase voucher redeemable at PIC NEGRE outlets; only where this is not possible will the refund be made in cash.
In the event of an injury duly evidenced by a medical certificate, the deadline for the 50% refund is extended to 31 January 2027.
Outside the above cases and deadlines, no refund of the amount paid will be given.
Although the equipment is used by a minor, the adult who enters into the contract will be responsible to PIC NEGRE for compliance with the contractual obligations, including in particular the proper use of the equipment, its care, custody, timely return, and payment of any amounts owed for damage, loss, theft, delay, or failure to return the equipment.
The CUSTOMER acknowledges that skiing is a sporting activity that carries inherent risks. PIC NEGRE will be responsible for the proper condition and preparation of the equipment to the extent legally required, but will not be liable for accidents arising from the sporting activity itself, the user's conduct, incorrect use of the equipment, or circumstances unrelated to the rented equipment, without prejudice to any liability legally attributable to PIC NEGRE.
The responsible adult must ensure that the minor uses the equipment in a manner appropriate to their age, physical condition, level and abilities.
If a card tokenization system is used, the corresponding express authorization must be obtained to securely store a bank token and make subsequent charges relating exclusively to obligations arising from the contract, such as damage, loss, theft, equipment not returned, or penalties. The system applicable to this product must be validated, in particular the token's period of validity for a seasonal rental.
The data controller for personal data is PIC NEGRE, SA. The data provided during contracting will be processed to manage the rental contract, identify the CUSTOMER and the user of the equipment, manage payments, deliveries, returns, incidents, maintenance, coverage, and other actions necessary for the proper provision of the service.
Processing will be carried out in accordance with Law 29/2021, of 28 October, on the qualified protection of personal data (LQPD), its implementing regulations, and PIC NEGRE's current privacy policy.
Where the contract arises from a promotion or QR code involving prior collection of personal data, such processing will also be subject to the information and privacy conditions provided in the corresponding form.
The CUSTOMER may exercise their data protection rights through the channels made available by PIC NEGRE and may consult further information at www.picnegre.com.
Signing the contract and paying for the rental confirm that the CUSTOMER:

These terms shall be governed by the laws in force in the Principality of Andorra. In the event of a dispute relating to the interpretation, performance or fulfilment of the contract, the Andorran courts shall have jurisdiction, subject in all cases to mandatory rules applicable to consumers and users.
