The CUSTOMER (the hirer) with all the personal data and the hired equipment listed on the front page of this contract acknowledges that the hired equipment is in a perfect STATE OF USE AND FUNCTIONING PROPERLY, and that before delivery the adjustment position of the fasteners has been determined in accordance with the ISO 11088 standard. The CUSTOMER has informed the person who has served him/her of his/her weight, physical condition and age and those of the other members of the group, as well as their ability to ski, having adjusted the fastenings in accordance with these conditions.
The hire entails the processing of data that include information on the HIRER (the person who hires the equipment), including an identification document, email address, telephone number, the status of his/her transactions, the hired PRODUCTS and his/her shoe size, weight and height. The Data Controllers are PIC NEGRE, SA and SHUSSKI, SL, which shall process the data provided for the exclusive use of this contract pursuant to Qualified Law LQPD 29/2021 of 28 October on personal data protection. Said data shall not be transferred to any third parties unless there is a legal obligation to do so. However, the rights to access, rectification, erasure and restriction of the data may be exercised by writing to Berta Faura, our DPO, at either firstname.lastname@example.org or email@example.com.
The HIRER acknowledges and accepts these terms and conditions before proceeding to pay for the HIRE of the equipment at the shop where the equipment is delivered.
These General Hire Conditions are listed on the front page of this contract and must be read before the order is placed. The HIRER is invited to read them carefully and to keep a copy of them, as appropriate.

USE OF THE EQUIPMENT
The USE OF THE EQUIPMENT is non-transferable and personal, unless the CUSTOMER hires the equipment as the primary holder of a group. In any event, the CUSTOMER undertakes to keep and use the hired equipment with due diligence and care and to return it at the end of the hire period in perfect condition and functioning properly. It is totally forbidden for the CUSTOMER to alter the adjustments of the fastenings or to remove the leash (safety strap) from the snowboard.
The MAIN HOLDER OF A GROUP shall be held directly and personally liable for all the obligations undertaken in this contract, both for the entirety of the hired equipment and for the personal liability that could apply to the other members of the group, without detriment to the CUSTOMER’s right of recourse. Therefore, the main holder of a group may not argue the liability of a third party in the event of any damages to exempt his/her personal liability, jointly and severally with all the members of the group, with regard to the entirety of the equipment hired and listed above.
TERMS OF PAYMENT
The CUSTOMER hereby provides to PIC NEGRE, SA and SHUSSKI, SL the details of his/her bank card so that they may be tokenised (anonymised) by the Server in order to conceal them and generate a specific token (code) for the CUSTOMER that is limited in time. Therefore, PIC NEGRE, SA and SHUSSKI, SL shall on no account store the bank details on the CUSTOMER’s card, only the token created for the above purpose. This token, which replaces the sensitive data on the bank card with a unique and personal numerical code, shall enable PIC NEGRE, SA and SHUSSKI, SL and the customer to perform all the monetary transactions covered by this contract in a virtual and secure manner. In this regard, the CUSTOMER AUTHORISES PIC NEGRE, SA and SHUSSKI, SL to use the token for the purpose of charging the cost of replacing the hired equipment to his/her bank card in the event that it is not returned or in the event of the loss or theft thereof, the amount of which shall be set at the market prices applied by PIC NEGRE, SA and SHUSSKI, SL. It is properly understood that, in the event that the equipment is stolen from the CUSTOMER by a third party, the CUSTOMER shall be held solely liable, PIC NEGRE, SA and SHUSSKI, SL shall be held harmless and the CUSTOMER shall be obliged to bear the cost of the equipment not returned. Similarly, PIC NEGRE, SA and SHUSSKI, SL are authorised to use the CUSTOMER’s token in order to charge the amount corresponding to the damage caused to the equipment to his/her bank card, as appropriate. The repair price shall be freely valued by PIC NEGRE, SA and SHUSSKI, SL but may on no account exceed the price of replacing the equipment, as well as the cost generated by any delay in the return of the hired equipment valued in accordance with the current rates. It is clearly understood that any delay in the return of the equipment shall be charged to the CUSTOMER as a whole day’s hire, even if it totals only half a day. The token assigned by the CUSTOMER shall be VALID for 7 DAYS following the hire period. From that moment onwards, PIC NEGRE, SA and SHUSSKI, SL shall not be able to use it for the purposes provided for in this contract. Therefore, in the event that, for whatever reason, PIC NEGRE, SA and SHUSSKI, SL cannot charge the amounts corresponding to the items indicated above, the CUSTOMER shall be obliged to pay them immediately.
RETURN OF EQUIPMENT AND DAMAGES
In the event that the CUSTOMER wishes to RETURN the hired equipment IN ADVANCE due to weather or health conditions or a force majeure, PIC NEGRE, SA and SHUSSKI, SL shall not be obliged to return any amount to the CUSTOMER, even if the equipment is returned in advance.
The CUSTOMER shall be held SOLELY LIABLE for any damage caused to the hired equipment throughout the hire period or for any damages or harm caused by the activity carried out with the hired equipment to him/herself and third parties. The CUSTOMER acknowledges and accepts that the snow sport activity to be carried out with the hired equipment may involve risks of injuries or other more serious accidents, fully accepting said risks and exempting PIC NEGRE, SA and SHUSSKI, SL from any liability in this regard.
In the event of any dispute, the CUSTOMER agrees to submit to the exclusive jurisdiction of the Andorran Courts.
