IMPORTANT: Please read these conditions carefully before confirming your reservation. By making the payment, you fully and unreservedly accept these General Rental Conditions.

1. Object of the Contract

This contract regulates the provision of the sports equipment rental service offered by Pic Negre, including:

  • Ski and snowboard equipment.
  • Cycling equipment: conventional bicycles, electric bikes (e-bikes), and mountain bikes.
  • Mountain equipment: baby carrier backpacks, trailers, poles, protections, and other accessories.

The characteristics, categories, and availability of the equipment will be described on the Pic Negre website and visible in the physical stores where the service is provided.

3. Reservation Conditions

3.1. The reservation will be valid once the process is completed on the website or in the store, including the express acceptance of these conditions and the full payment of the service.

3.2. The customer confirms having read, understood, and accepted these general conditions, which are available on the website and visible in the store.

3.3. The customer agrees to provide truthful and complete data during the reservation. In case of errors derived from incorrect data provided by the customer, the correction may require manual management by the Pic Negre team.

3.4. Online prices may be lower than in-store prices. There are no intermediaries or additional management costs when booking online.

3.5. Availability and Equivalents
The reservation guarantees the provision of the rental service on the contracted dates. In the exceptional event of temporary unavailability of a specific model, Pic Negre may deliver equipment of an equivalent or higher category. If it is not possible to provide the contracted rental, the refund conditions provided in section 8 will apply.

4. Online Booking Process

To make a reservation you must:

  • Select the store where you wish to pick up the equipment.
  • Choose the dates and duration of the rental.
  • Select the equipment according to level, size, or specific needs.
  • Make the payment using the available methods.
  • Download and print the reservation voucher that will be sent by email and present it at the store.

ℹ️ If the customer does not present the voucher in the store, the reservation may be validated by name, email, or reservation number in the system.

ℹ️ If a product or size is not available in the online booking engine, the reservation must be managed directly with the store through the official channels (phone / email). Availability will be confirmed once the customer receives written confirmation and payment has been made.

5. Prices and Payment

5.1. Prices are public and detailed in the Rates section of the website and in Pic Negre stores.

5.2. Payment is made at the time of booking by bank card (Visa, Mastercard) through the secure gateway managed by Andbank.

5.3. Financial expenses, commissions, or surcharges derived from the use of cards issued outside the country will be borne entirely by the customer.

5.4. Bank details are encrypted and do not pass through Pic Negre's systems; the company does not store or manage the customer's banking information.

5.5. The reservation is considered definitive after the successful charge and receipt of the confirmation email including the pick-up voucher.

6. Rental Duration, Pick-up, and Return of Equipment

6.1. The rental begins upon pick-up at the store and ends on the day the equipment is returned.

6.2. Pick-up can be made from the store's opening time on the rental start date. Likewise, the customer may pick up the equipment the day before the start of the rental from 5:00 p.m., subject to availability.

6.3. A credit/debit card or an identity document may be requested as a guarantee at the time of pick-up.

6.4. The equipment must be returned to the same store where it was picked up, in the same condition as it was delivered.

6.5. Failure to return the equipment on the agreed date may generate additional charges equivalent to extra rental days, depending on the days of delay.

7. Use of Equipment

7.1. The use of the rented equipment is personal and non-transferable.

7.2. The customer declares to have checked the condition of the equipment upon pick-up and acknowledges that it is delivered in optimal conditions of use.

7.3. It is prohibited to modify, manipulate, or replace equipment components without express authorization from the store staff. This includes the adjustment of ski bindings.

7.4. Prohibited use of e-bikes and enduro bikes on downhill circuits (DH) and Bike Parks. Non-compliance with this prohibition will result in a penalty of €300.

7.5. Misuse of the equipment will result in a charge equivalent to the cost of repair or replacement, according to the assessment of Pic Negre's technical staff.

7.6. Loss, theft, or severe damage to the equipment will require the customer to pay the replacement value, unless they have a contracted Pic Negre guarantee covering such incidents (see section 13).

8. Cancellations, Modifications, and Refunds

8.1. Cancellation by the customer
The customer may cancel their reservation up to 48 hours before the start of the rental and will receive a full refund through the same payment method.

8.2. Force majeure
In duly justified cases of force majeure, Pic Negre may apply a full or proportional refund of the unused rental, depending on the degree of use.

For the purposes of these conditions, the following will be considered cases of force majeure (provided they objectively prevent starting or continuing the rental):

  • Accident or injury of the reservation holder or a member of the group that makes sports practice impossible.
  • Acute illness preventing the activity (high fever, gastroenteritis, infection with prescribed bed rest).
  • Death of an immediate family member.
  • Unexpected severe medical complication or sudden medical contraindication.
  • Traffic accident or mechanical breakdown with proven immobilization of the vehicle.
  • Cancellation or severe delay in public transport (flight, train, bus) making arrival impossible.
  • Official access closures due to extraordinary causes (extreme snowfalls, avalanches, emergencies, or road closures by competent authority).

Minimum required supporting documentation: medical/emergency report, police report or accident statement, tow truck/garage report, transport company certificate, or official statement from the competent authority. The customer must communicate the incident as soon as possible and provide the documentation within a maximum period of 7 days from the event.

⚠️ Important: Under no circumstances will force majeure give the right to a refund for expenses unrelated to the rental (ski passes, lessons, accommodation, transport, or other third-party services).

8.3. Cancellation and modification channels
To cancel or modify a reservation, the customer must contact Pic Negre through official channels:

8.4. Refunds
Once the cancellation or applicable refund is approved, the refund will be processed using the same payment method used for the purchase. The estimated time is 3 to 4 business days, which may vary depending on the issuing bank's operations, a circumstance beyond Pic Negre's control.

8.5. Availability incidents (including overbooking)
If, for reasons attributable to Pic Negre, it is not possible to deliver the reserved equipment, Pic Negre will offer, in this order:

  • Equivalent or higher category equipment.
  • Change to another Pic Negre store, if viable and accepted by the customer.
  • Change of date or time, if accepted by the customer.
  • Total or proportional refund of the unused rental amount.

⚠️ Under no circumstances will expenses unrelated to the rental service be refunded (see section 10.4).

8.6. Proof of incident
Upon the customer's request, Pic Negre may issue a basic proof of the incident regarding the rental service (date, store, and type of incident) for use with third parties (insurance, providers), without this implying the assumption of external expenses or acknowledgment of liability for services unrelated to the rental.

9. Customer Responsibility

9.1. The customer is responsible for the equipment from the moment of pick-up until its effective return to the store.

9.2. The customer will be responsible for any costs arising from loss, theft, damage, or misuse of the equipment not covered by a contracted Pic Negre guarantee.

9.3. The customer may not replace the equipment with a different one without the express authorization of the store staff.

9.4. The customer agrees to return the equipment within the agreed period and in the original delivery condition.

10. Limitation of Liability

10.1. Pic Negre will not be liable for personal injuries, accidents, or losses suffered during the use of the rented equipment, except for technical defects directly attributable to the equipment itself.

10.2. The customer declares to have the necessary experience, physical capacity, and knowledge to use the rented equipment safely.

10.3. The use of sports equipment involves inherent risks that the customer assumes under their sole responsibility.

10.4. Exclusion of expenses unrelated to the rental service
Pic Negre is solely responsible for the proper provision of the contracted sports equipment rental service. Consequently, Pic Negre will not assume or refund amounts or expenses derived from services or products contracted by the customer with third parties, independent of the rental contract, including but not limited to:

  • Ski passes or resort season tickets.
  • Lessons, schools, or activities related to sports practice not provided by Pic Negre.
  • Travel or accident insurance contracted by the customer.
  • Accommodation (hotels, apartments, campsites, or other formulas).
  • Food and beverage.
  • Transport (taxis, own vehicle, fuel, parking, flights, train, or bus tickets).
  • Loss of opportunity, moral damages, or lost profits of any kind.

In these types of situations, as a commercial courtesy to the customer and without acknowledgment of liability, Pic Negre may voluntarily offer a proportional compensation in the form of a voucher or rental adjustment.

10.5. Indirect or consequential damages
Under no circumstances will Pic Negre be liable for indirect, consequential damages, or lost profits arising from a service incident, limiting itself, where appropriate, to the refund or adjustment of the unused rental amount in accordance with these General Conditions.

11. Personal Data Protection

11.1. The personal data collected will be used to manage the reservation and, unless expressly opposed, for commercial communications from Pic Negre.

11.2. The customer can exercise their rights of access, rectification, cancellation, and opposition (ARCO rights) by emailing info@picnegre.com.

11.3. Data processing is carried out in accordance with current regulations in the Principality of Andorra.

12. Legal Notices and Information Update

12.1. Pic Negre will not be responsible for errors, inaccuracies, or omissions in the information contained on the website or informational materials.

12.2. Pic Negre may modify, update, or correct the information and these conditions at any time without prior notice. In any case, the conditions in force at the time of contracting will apply.

12.3. The customer agrees not to use the website for illegal, defamatory activities, or those contrary to public order.

13. Pic Negre Guarantees

13.1. Pic Negre sells its own guarantees for rental equipment (ski, snowboard, accessories, clothing, and bicycles) in order to cover possible unforeseen events such as breakage, loss, or theft. These guarantees reduce the amount the customer must pay in the event of an incident involving the rented equipment.

13.2. Each purchased guarantee is associated with specific rented equipment and is not transferable to another piece of equipment.

13.3. The price of each guarantee varies according to the modality and/or range of the equipment. Prices are available on all communication channels and are always visible in stores.

13.4. The guarantee must be purchased prior to the delivery of the equipment. If the rental has been booked online, the guarantee may be purchased in-store at the time of pick-up, with the same validity as if it had been contracted jointly in the online process.

13.5. Guarantee coverage

  • In case of breakage of the equipment: the guarantee covers 100% of the equipment's value (the customer pays nothing additional, €0).
  • In case of loss or theft: the guarantee covers 50% of the equipment's value (the customer pays the remaining 50% according to the table below).

13.6. Without contracted guarantee
In case of breakage, loss, or theft without a contracted guarantee, the customer must pay 100% of the equipment's value according to the current price table.

Important:

  • With contracted guarantee: In case of breakage of the equipment, the customer does not have to pay any additional amount (€0). In case of loss or theft, the customer will pay 50% of the value according to the "With Guarantee" column.
  • Without guarantee: The customer must pay 100% of the equipment's value in case of breakage, loss, or theft, according to the "Without Guarantee" column.

14. Acceptance of the General Conditions

By completing the reservation process and clicking the Accept button, or by signing the pick-up document in the store, the customer expressly and unequivocally declares that they have read, understood, and accepted these General Rental Conditions in their entirety.
