GENERAL TERMS AND CONDITIONS OF RENTAL
Current version — Sports equipment: skiing, snowboarding, cycling, and mountain sports
1. Object of the Contract
This contract regulates the provision of the sports equipment rental service offered by Pic Negre, including:
- Ski and snowboard equipment.
- Cycling equipment: conventional bikes, electric bikes (e-bikes), and mountain bikes (MTB).
- Mountain gear: baby carrier backpacks, trailers, poles, protections, and other accessories.
The characteristics, categories, and availability of the equipment will be described on the Pic Negre website and visible in the physical stores where the service is provided.

3. Booking Conditions
3.1. The booking will be valid once the process on the website or in the store is completed, including the express acceptance of these conditions and the total payment for the service.
3.2. The customer confirms having read, understood, and accepted these general conditions, available on the website and visible in the store.
3.3. The customer agrees to provide true and complete data during the booking. In case of errors resulting from incorrect data provided by the customer, correction may require manual management by the Pic Negre team.
3.4. Online prices may be lower than in-store prices. There are no intermediaries or additional management costs when booking online.
3.5. Availability and Equivalencies
The booking guarantees the provision of the rental service on the contracted dates. In exceptional cases of temporary unavailability of a specific model, Pic Negre may provide equipment of an equivalent or superior category. If it is not possible to provide the contracted rental, the refund conditions provided in section 8 will apply.
4. Online Booking Process
To make a booking you must:
- Select the store where you wish to collect the equipment.
- Choose the dates and duration of the rental.
- Select the equipment according to level, size, or specific needs.
- Make the payment using the available methods.
- Download and print the booking voucher that will be sent by email and present it at the store.
ℹ️ If the customer does not present the voucher at the store, the booking can be validated by name, email, or booking number in the system.
ℹ️ If a product or size is not available in the online booking engine, the booking must be managed directly with the store through official channels (phone / email). Availability will be confirmed when the customer receives written confirmation and the payment has been made.
5. Prices and Payment
5.1. Prices are public and detailed in the Rates section of the website and in Pic Negre stores.
5.2. Payment is made at the time of booking by bank card (Visa, Mastercard) through the secure gateway managed by Andbank.
5.3. Financial expenses, commissions, or surcharges derived from the use of cards issued outside the country will be borne entirely by the customer.
5.4. Bank details are encrypted and do not pass through Pic Negre's systems; the company does not store or manage the customer's banking information.
5.5. The booking is considered final after effective collection and receipt of the confirmation email including the collection voucher.
6. Rental Duration, Collection, and Return of Equipment
6.1. The rental begins upon collection at the store and ends on the day of the equipment's return.
6.2. Collection can be made from the opening of the store on the start date of the rental. Additionally, the customer may collect the equipment the day before the start of the rental from 5:00 PM, subject to availability.
6.3. A credit/debit card or an identity document may be requested as a guarantee at the time of collection.
6.4. Equipment must be returned to the same store where it was collected, in the same conditions in which it was delivered.
6.5. Failure to return the equipment on the agreed date may generate additional charges equivalent to extra rental days, depending on the days of delay.
7. Use of Equipment
7.1. The use of the rented equipment is personal and non-transferable.
7.2. The customer declares to have inspected the condition of the equipment upon collection and acknowledges that it is delivered in optimal conditions for use.
7.3. It is forbidden to modify, manipulate, or replace equipment components without express authorization from store personnel. This includes the adjustment of ski bindings.
7.4. Prohibited use of e-bikes and enduro bikes on downhill (DH) tracks and Bike Parks. Non-compliance with this prohibition will result in a penalty of €300.
7.5. Misuse of the equipment will result in a charge equivalent to the cost of repair or replacement, according to the valuation of Pic Negre's technical staff.
7.6. Loss, theft, or serious damage to the equipment will oblige the customer to pay the replacement value, unless they have a contracted Pic Negre Guarantee covering such incidents (see section 13).
8. Cancellations, Modifications, and Refunds
8.1. Cancellation by the customer
The customer may cancel their booking up to 48 hours before the start of the rental and will receive a full refund via the same payment method. Cancellations can also be made via email at info@picnegre.com indicating the order number and necessary identification data. Website cancellation does not imply immediate refund. Cancellations within the 48-hour period will also be 100% refunded. To process the refund, the customer must email info@picnegre.com.
8.2. Force Majeure
In duly justified cases of force majeure, Pic Negre may apply a full or proportional refund of the unused rental. Force majeure events include:
- Accident or injury to the holder or a group member that prevents sports practice.
- Acute illness preventing the activity (high fever, gastroenteritis, infection with indicated rest).
- Death of a direct relative.
- Serious unexpected medical complication or sudden medical contraindication.
- Traffic accident or mechanical breakdown with certified immobilization of the vehicle.
- Serious cancellation or delay in public transport (flight, train, bus) making arrival impossible.
- Official access closures due to extraordinary causes (extreme snowfall, avalanches, emergencies, or road closures).
Minimum required documentation: medical/emergency report, police report, towing/garage report, or official statement. The customer must communicate the incident as soon as possible and provide documentation within a maximum of 7 days.
⚠️ Important: Under no circumstances will force majeure entitle the customer to a refund for expenses external to the rental (ski passes, lessons, accommodation, transport, or other third-party services).
8.3. Cancellation and Modification Channels
To cancel or modify a booking, the customer must contact Pic Negre via email at info@picnegre.com providing the required data. The customer service phone (+376) 737 720 serves as informational support, but any request must be processed in writing.
8.4. Refunds
Once the cancellation is approved, the refund will be processed via the same payment method within 3 to 4 business days. Processing time depends on the email receipt and bank operations.
8.5. Availability Incidents (including overbooking)
If, for reasons attributable to Pic Negre, it is not possible to deliver the reserved equipment, the following will be offered in this order: Equivalent or superior equipment, store change, date change, or total/proportional refund.
⚠️ Under no circumstances will expenses external to the rental service be refunded.
8.6. Proof of Incident
Upon customer request, Pic Negre may issue a basic incident certificate for use with third parties (insurance, providers), without implying acceptance of external costs.
9. Customer Responsibility
9.1. The customer is responsible for the equipment from collection until its effective return to the store.
9.2. The customer will be responsible for any cost derived from loss, theft, damage, or misuse not covered by a contracted Pic Negre Guarantee.
9.3. The customer may not replace the equipment with a different one without express authorization.
9.4. The customer agrees to return the equipment within the agreed period and in its original condition.
10. Limitation of Liability
10.1. Pic Negre will not be liable for personal injury, accidents, or losses suffered during the use of the rented equipment, except for technical defects directly attributable to the equipment itself.
10.2. The customer declares to have the necessary experience, physical capacity, and knowledge.
10.3. The use of sports equipment involves inherent risks that the customer assumes entirely.
10.4. Exclusion of expenses external to the rental service:
Pic Negre will not assume or refund amounts for: ski passes, lessons or schools, external travel insurance, accommodation, meals, transport (taxis, parking, tickets), or moral damages/loss of profit.
10.5. Indirect Damages: In no case will Pic Negre be liable for indirect or consequential damages, limiting itself to the refund or adjustment of the unused rental amount.
11. Personal Data Protection
11.1. Data collected will be used to manage the booking and, unless expressly opposed, for commercial communications.
11.2. The customer may exercise their rights of access, rectification, cancellation, and opposition (ARCO) via info@picnegre.com.
11.3. Data processing is carried out in accordance with current regulations in the Principality of Andorra.
12. Legal Notices and Information Updates
12.1. Pic Negre will not be held responsible for errors or omissions in the information contained on the web.
12.2. Pic Negre may modify these conditions at any time without prior notice.
13. Pic Negre Guarantees
13.1. Pic Negre sells its own guarantees for rental equipment to cover unforeseen events such as breakage, loss, or theft.
13.4. The guarantee must be purchased prior to equipment delivery.
13.5. Coverage:
- Breakage: Covers 100% of the value (the customer pays €0).
- Loss or Theft: Covers 50% of the value (the customer pays the remaining 50% according to the table).

✅ With contracted guarantee: In case of breakage, the customer does not have to pay any additional amount (€0). In case of loss or theft, they pay 50% of the value ("With Guarantee" column).
❌ Without guarantee: The customer must pay 100% of the equipment value in case of breakage, loss, or theft ("Without Guarantee" column).
14. Acceptance of the General Conditions
By completing the booking process and clicking the Accept button, or by signing the collection document at the store, the customer expressly and unequivocally declares that they have read, understood, and accepted these General Terms and Conditions of Rental in their entirety.
